9th Circuit denies Trump DOJ bid to make California set aside likely noncitizen ballots
The court rejected the Justice Department's request after it flagged about 20,000 likely noncitizen voters. A later legal filing found more than 40% of the names were not on California's voter rolls and that citizens appear on the list.[8, 9] The DOJ had asked California to either verify those voters' legal status or segregate any ballots cast from people on the list.[7, 8] On Saturday, lawyers for the Coalition for Humane Immigrant Rights filed a supplemental brief in the U.S. District Court for the District of Columbia saying citizens among the group's members and clients appeared on the DOJ list.[3]
The filing was also the first outside analysis of the list, which PBS NewsHour reported the Justice Department has used to threaten prosecution of election officials.[5, 9] PBS NewsHour reported that thousands of U.S. citizens appear to be flagged as ineligible to vote on the list.[5]
Why it matters The list is the basis for the Justice Department's threats to prosecute election officials.[5, 9]
