Judge denies DOJ bid to set aside 20,000 California ballots; DOJ appeals
The Justice Department appealed soon after the ruling, and attorneys on both sides were preparing for further court action.[14, 23, 25] The legal fight began last week when the DOJ asked California to segregate the ballots, and the department has reportedly subpoenaed California election officials who refused.[28, 31] In a separate dispute, the DOJ identified about 400 people in Washington state it suspects are noncitizen voters, according to The Western Journal and One America News Network.[26, 30]
Washington Secretary of State Steve Hobbs responded that "many" U.S. citizens were included on the DOJ list and said that without individualized proof of ineligibility the request was "profoundly disappointing."[15, 21] A federal judge in Washington, D.C., separately ordered the Justice Department on Thursday to disclose more information about letters it has sent to several states demanding they set aside ballots of alleged noncitizens.[20, 29]
Why it matters The Justice Department has appealed, keeping the litigation over the ballots alive days before the midterm elections.[14, 23, 25]
